Terms of Service

1. Acceptance of Terms & Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Billiball ("we", "us", or "our") concerning your access to and use of the Billiball mobile application, multiplayer servers, websites, content, and related digital services (collectively, the "Services").

By installing, copying, accessing, or playing Billiball, you affirmatively accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately uninstall the application and discontinue any use of our Services.

2. Eligibility & Age Requirements

You must be at least 13 years old (or the minimum legal age required in your country of residence to enter into a binding contract) to play Billiball. If you are between the ages of 13 and the age of majority in your jurisdiction, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Services, you warrant that you possess the legal capacity to enter into this agreement and that your participation does not violate any applicable local, state, national, or international law.

3. User Accounts & Security

To enjoy the complete features of Billiball, you may link an external account via Google Sign-In or Apple Sign-In, or play as an unauthenticated guest.

• Account Ownership: You are granted a limited license to access your account; you do not own the account or its associated data. Accounts are non-transferable, and you may not sell, rent, lease, or share access to your account with any third party.
• Account Security: You are exclusively responsible for maintaining the confidentiality of your authentication credentials and device security. You agree to immediately notify us of any unauthorized access or security breach regarding your account.
• Guest Accounts: Playing under a guest account stores data linked to your current device installation. Uninstalling the application, wiping local app storage, or changing devices without linking a persistent account may result in the permanent loss of all progress, achievements, and virtual currency without any entitlement to recovery or compensation.

4. Limited License & Intellectual Property Rights

Subject to your ongoing compliance with these Terms, Billiball grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and execute the application on authorized mobile devices solely for your personal, non-commercial entertainment.

All intellectual property rights, titles, and interests in and to the Services—including software source and object code, physics simulation models, cue graphics, table textures, 2D/3D art assets, animations, sound recordings, music compositions, trademarks, logos, and UI designs—are the exclusive property of Billiball and its licensors.

You agree that you will not:

• Copy, modify, adapt, translate, create derivative works from, or reverse engineer any part of the game client or server protocols.
• Decompile, disassemble, or attempt to derive underlying source code, algorithms, or proprietary network payloads.
• Remove, obscure, or alter any copyright notices, trademark tags, or proprietary rights designations displayed within the game.
• Use the Services to develop competing billiard or multiplayer sports simulation software.

5. Virtual Items, In-Game Currency & Subscriptions

Billiball may offer virtual in-game currencies (such as coins, gems, or chips), VIP status passes, cue skins, custom chalk, and decorative avatar frames (collectively, "Virtual Items"). Virtual Items are digital content licensed, not sold, to you.

• No Real-World Value: Virtual Items have no monetary or cash equivalent and do not constitute real currency or property of any type. Virtual Items cannot be redeemed, sold, traded, or exchanged for fiat currency or tangible goods from us or any third party.
• Purchase Finality: All purchases of Virtual Items and VIP memberships made through Apple In-App Purchase or Google Play Billing are final, non-refundable, and non-cancellable, except as expressly provided by platform store policies or mandatory consumer protection laws in your jurisdiction.
• Right to Regulate: We reserve the absolute right to manage, regulate, adjust, price, balance, modify, or discontinue Virtual Items at any time without prior notice or liability to you.
• VIP Renewals & Expiration: VIP subscriptions grant temporary benefits for a designated period. In-game benefits, tax fee discounts, and custom perks terminate automatically upon the expiration of your active VIP duration.

6. Code of Conduct, Anti-Cheat & Fair Play

We maintain a zero-tolerance policy towards cheating, game manipulation, and toxic behavior to guarantee a fair competitive environment for all players. You expressly agree not to engage in any of the following prohibited behaviors:

• Hacks & Exploits: Utilizing aim-prediction overlays, ball trajectory mods, memory injectors, automated bots, macros, or modified APKs/IPAs.
• Match Fixing & Win Trading: Colluding with opponents, deliberately throwing matches, or manipulating matchmaking queues to artificially inflate rank, streaks, or coin balances.
• Bug Exploitation: Knowingly taking advantage of table geometry glitches, server desync issues, or network disconnect exploits for competitive or economic gain. Any discovered glitches must be reported immediately to our support team.
• Network Interference: Artificially introducing packet loss, lag-switching, denial-of-service (DoS) attacks, or intercepting WebSocket communications between client and server.
• Harassment & Inappropriate Conduct: Using offensive, defamatory, racist, sexually explicit, or abusive language in user profiles, avatars, or chat messages.

Any infraction may result in disciplinary action up to and including rating resets, forfeiture of virtual currency, temporary bans, or permanent hardware-level account termination without refund.

7. User Feedback & Submissions

If you choose to submit suggestions, bug reports, creative ideas, or feedback regarding Billiball, you acknowledge and agree that we may use, incorporate, adapt, and exploit such feedback without any restriction, credit, or financial compensation to you. All submitted feedback becomes the sole intellectual property of Billiball upon submission.

8. Service Availability, Maintenance & Updates

We continually update Billiball to fix bugs, balance game mechanics, and introduce new gameplay features. Consequently:

• We do not guarantee that the game will be available at all times, in all locations, or without interruption.
• We may conduct scheduled or emergency server maintenance, resulting in temporary service downtime.
• You may be required to download and install application updates (force upgrade) to continue playing. We are not responsible for compatibility issues on unsupported OS versions or deprecated hardware.

9. Third-Party Links & Advertising

The Services may display advertisements from third parties (such as Google AdMob) or include links to external websites and services. We do not endorse, inspect, or assume responsibility for any third-party content, advertisements, goods, services, or privacy practices. Your interactions with third-party advertisers are solely between you and the respective provider.

10. Account Termination & Suspension

We reserve the right to suspend, terminate, or delete your account and restrict your access to the Services, at our sole discretion, without liability and without prior notice, if:

• You breach or threaten to breach any provision of these Terms or the Fair Play policy.
• We suspect fraudulent, deceptive, or illegal activity associated with your account or payment methods.
• Your account remains inactive for an uninterrupted period exceeding 12 consecutive months.
• We cease operating the Billiball game in your geographical region or entirely.

You may terminate these Terms at any time by deleting your account via the in-app settings or emailing support@billiball.com and uninstalling the application. Upon termination, all licenses granted to you terminate immediately, and all Virtual Items in your account are forfeited.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, BILLIBALL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS OR PHYSICS SIMULATION DISCREPANCIES WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BILLIBALL, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES—INCLUDING LOSS OF PROFITS, LOSS OF DATA, GOODWILL, WORK STOPPAGE, DEVICE MALFUNCTION, OR FINANCIAL LOSSES—ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO BILLIBALL FOR IN-APP PURCHASES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS LESS.

13. Indemnification

You agree to defend, indemnify, and hold harmless Billiball, its affiliates, contractors, licensors, and employees from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any fraudulent or illegal acts committed through your account.

14. Dispute Resolution & Governing Law

These Terms and any disputes arising out of or related to your use of the Services shall be governed by and interpreted in accordance with applicable laws, excluding conflict-of-law principles.

Before initiating formal legal proceedings, you and Billiball agree to make a good-faith effort to resolve any dispute informally by contacting our legal representatives at support@billiball.com. If the dispute cannot be resolved within forty-five (45) days of notice, the dispute shall be resolved through final and binding arbitration or brought before a court of competent jurisdiction.

YOU AND BILLIBALL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Severability & Entire Agreement

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, represent the entire agreement between you and Billiball regarding the Services and supersede all prior or contemporaneous agreements, understandings, representations, and communications.

16. Amendments to Terms

We reserve the right to amend or update these Terms at any time at our sole discretion. We will indicate the date of the latest revisions at the top of this document. Material updates may also be communicated through in-app banners or update prompts. Your continued use of Billiball after any changes indicates your complete acceptance of the amended Terms.
